Terms of Service
These Terms of Service (“Terms”) govern access to and use of the Tiana & Co. website and the reports and filings it produces (together, the “Service”), operated by Tiana & Co. LLC, a New York limited liability company (“Tiana & Co.,” “the Company”). By purchasing or using the Service, the purchaser (“the customer”) agrees to these Terms.
1. What the Service is
Tiana & Co. is an on-demand compliance screening and filing-preparation service for small importers. Currently live: Screen a Supplier ($29, a cited report checking a supplier against U.S. forced-labor and sanctions watch lists plus import-documentation requirements); CPSC Product Registry Filing ( $39, formatting submitted product data into the U.S. Consumer Product Safety Commission’s bulk-upload file format); and the Certificate Requirement Check (free of charge, indicating which route CPSC’s published guidance points to for a described product). Each paid purchase is a one-time transaction — there is no subscription and nothing auto-renews. The Certificate Requirement Check involves no payment, no account, and no purchase of any kind.
2. Not a customs broker, not legal advice
Tiana & Co. is a research and screening tool. It is not a licensed customs broker, does not file anything with U.S. Customs and Border Protection on a customer’s behalf, and does not provide legal advice. Reports cite official government sources and are intended to help a customer understand and prepare — a licensed customs broker makes the actual filing decision and submission. Nothing in a report or filing output constitutes a guarantee that goods will clear customs, that a shipment will not be held, or that a product complies with any regulation.
This applies with equal force to the free Certificate Requirement Check. That feature reports which route CPSC’s published guidance points to, based on the customs code and the answers the user supplies about their own product. It does not decide whether any federal standard reaches a particular product, is not a legal opinion, and is not a substitute for a licensed customs broker. Its output carries no warranty of any kind, and the fact that it is provided free of charge does not imply any additional assurance about its accuracy.
Government watch-list checks reflect what the underlying government sources (DHS/FLETF, OFAC, CPSC, and others named in each report) published as of the snapshot date stated on that report. A “could not corroborate” or “clear” result reflects the absence of a match in those specific sources — it is not a statement that no risk exists.
3. Payment
This section applies to the paid products only; the Certificate Requirement Check has no checkout. Payments are processed by Stripe. Tiana & Co. does not store full payment card numbers. Each report or filing is a single, one-time charge at the price shown at checkout. Prices may change over time; the price that applies to an order is the one displayed at checkout for that order. See the Refund Policy for what happens if something goes wrong with an order.
If there is a problem with an order, the customer agrees to contact support@tiana-co.com first and allow a reasonable opportunity to resolve it, before disputing the charge with a bank or card issuer. Most issues are resolved faster this way than through a dispute. Filing a chargeback without first making contact is a breach of these Terms, and Tiana & Co. may suspend access to the Service and to any reports or filings associated with the disputed order.
4. Accessing a purchased report or filing
This section applies to purchased reports and filings. The Certificate Requirement Check produces an on-screen answer only — there is no access link, no email, and no stored record to return to; running it again costs nothing.
A purchased report or filing is accessed through a private link (a long, random web address) sent to the email provided at checkout, or available immediately after payment. That link expires after a period stated at the time of purchase (currently 30–90 days). The underlying report record is kept — an expired link can be re-issued by verifying the email address on file, through the re-access page for that product. The customer is responsible for keeping their access link and the email address on file accurate and confidential; anyone with the link can view the report.
5. Information submitted by the customer
The customer is responsible for the accuracy of the supplier names, product descriptions, manufacturing details, and any other information submitted. Optional free-text context a customer provides about their own situation is used only to shape how a report’s narrative is framed — it never changes what is checked or how a finding is characterized, and is never reproduced verbatim in a delivered report.
6. Acceptable use
The Service may not be used to attempt to access another customer’s report, to probe or overload the underlying compliance-checking systems, to resell or redistribute report content as if it were the customer’s own screening infrastructure, or for any unlawful purpose.
7. Disclaimers and limitation of liability
The Service is provided “as is.” To the fullest extent permitted by law, Tiana & Co. disclaims all warranties, express or implied, including fitness for a particular purpose. Tiana & Co.’s total liability arising from any order is limited to the amount paid for that specific report or filing. Where a feature is provided free of charge — including the Certificate Requirement Check — no amount has been paid, and liability arising from its use is limited accordingly to the fullest extent permitted by law. Tiana & Co. is not liable for a shipment being held, a fine, a lost sale, or any other consequence of a customer’s import or business decisions, whether or not those decisions relied on a report.
8. Changes to these Terms
These Terms may be updated from time to time; the “Last updated” date at the top of this page reflects the most recent version. Continued use of the Service after a change constitutes acceptance of the updated Terms.
Dated versions of these Terms, each with a digest identifying its exact text, are kept in the Terms archive. When these Terms are accepted, that acceptance is recorded against the digest of the version then in force.
9. Governing law and where disputes are heard
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the Service is subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York, and both parties consent to venue there.
Nothing above prevents either party from bringing an individual claim in a small-claims court that has jurisdiction. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class or representative proceeding.
